General Terms of Sale

These terms govern the sale of products by Skinergy Cosmetics ("we", "us", "our") through our online store to consumers in Ireland and the EU. By placing an order, you agree to these terms.

Right of Withdrawal
If you are a consumer based in the EU, you have the right to withdraw from your order within 14 days of receiving your goods, without giving any reason. To exercise this right, please use the withdrawal/cancellation function available on our Withdrawal Form. You do not need to call or email us — submitting this form is sufficient, and you will receive confirmation once it's processed. Please note: for hygiene reasons, this right does not apply to products that have been opened, used, or where the seal has been broken, except where required by law. Refunds will be issued within 14 days of us receiving the returned goods or proof of return, whichever is earlier, to your original payment method. For full details on returns, exchanges, and the withdrawal process, please see our Return and Refund Policy.

Mobile Terms of Service

The Skinergy Cosmetics mobile message service (the "Service") is operated by Skinergy Cosmetics  (“Skinergy Cosmetics ”, “we”, or “us”). Your use of the Service constitutes your agreement to these terms and conditions (“Mobile Terms”). We may modify or cancel the Service or any of its features without notice. To the extent permitted by applicable law, we may also modify these Mobile Terms at any time and your continued use of the Service following the effective date of any such changes shall constitute your acceptance of such changes.

By consenting to Skinergy Cosmetics' SMS/text messaging service, you agree to receive recurring SMS/text messages from and on behalf of Skinergy Cosmetics through your wireless provider to the mobile number you provided, even if your mobile number is registered on any state or federal Do Not Call list. Text messages may be sent using an automatic telephone dialing system or other technology. Promotional messages may include promotions, specials, and other marketing offers (e.g., cart reminders).

You understand that you do not have to sign up for this program in order to make any purchases, and your consent is not a condition of any purchase with Skinergy Cosmetics. Your participation in this program is completely voluntary.

We do not charge for the Service, but you are responsible for all charges and fees associated with text messaging imposed by your wireless provider. Message frequency varies. Message and data rates may apply. Check your mobile plan and contact your wireless provider for details. You are solely responsible for all charges related to SMS/text messages, including charges from your wireless provider.

You may opt-out of the Service at any time. Text the single keyword command STOP to +353 85 167 7289 or click the unsubscribe link (where available) in any text message to cancel. You'll receive a one-time opt-out confirmation text message. No further messages will be sent to your mobile device, unless initiated by you. If you have subscribed to other Skinergy Cosmetics mobile message programs and wish to cancel, except where applicable law requires otherwise, you will need to opt out separately from those programs by following the instructions provided in their respective mobile terms.

We may change any short code or telephone number we use to operate the Service at any time and will notify you of these changes. You acknowledge that any messages, including any STOP requests, you send to a short code or telephone number we have changed may not be received and we will not be responsible for honouring requests made in such messages.

The wireless carriers supported by the Service are not liable for delayed or undelivered messages. You agree to provide us with a valid mobile number. If you get a new mobile number, you will need to sign up for the program with your new number.

To the extent permitted by applicable law, you agree that we will not be liable for failed, delayed, or misdirected delivery of any information sent through the Service, any errors in such information, and/or any action you may or may not take in reliance on the information or Service.

Patch Testing

It is strongly advised to conduct patch tests before the application of any skincare or cosmetic product. Patch testing serves as a precautionary measure to assess potential adverse reactions or sensitivities that an individual may have to certain ingredients within the product. This procedure involves applying a small amount of the product to a discreet area of the skin, such as the inner forearm or behind the ear, and observing for any signs of irritation, redness, or inflammation or any reaction over a period of 24 to 48 hours.

Promotional Activity & Competitions

Where a promotion has been offered, it is valid for the time period indicated only and cannot be retrospectively applied.

• Sitewide offers: all sitewide discounts exclude gift sets, bundles and already discounted items.
  
• Free shipping promotions: free shipping is available during specific promotional dates and applies only to the Republic of Ireland.
• Gift with purchase: gifts with purchase during promotional periods are available while stocks last.

We do not give any warranty, condition, guarantee, or representation, express or implied, relating to the information contained on this website, or on any website to which it is linked.

We make no representations or warranties concerning the accuracy, completeness or suitability for any purpose of the information and related graphics contained on this website, or on any website to which it is linked.

We do not warrant that our website or any website to which it is linked or relevant server are free of computer viruses or other harmful applications.

Payments

We accept all major credit and debit cards. Customer credit card information is not stored by us on our servers.

All credit and debit cardholders are subject to validation checks and authorisation by the card issuer. If the issuer of your payment card refused to authorise payment to us, we will not be liable for any delay or non-delivery.

Delivery

The delivery period given when you receive your order is approximate. In the unlikely event that an item you ordered is not in stock, we will contact you to inform you of the expected delivery date. Should you subsequently decide not to pursue your order, we will cancel same and issue you with a full refund.

If you are ordering more than one item, your goods may be sent to you in instalments if certain items are out of stock. We will contact you to inform you of any goods that are not in stock.

If you order products from our website for international delivery, may be subject to import duties and taxes which are levied when delivery reaches the specified destination. You will be responsible for payment of any such import duties and taxes. Please note that we have no control over these charges and cannot predict their amount. Please contact your local customs office for further information before placing your order.

Please note that you must comply with all applicable laws and regulations of the country for which the products are destined. We will not be liable for any breach by you of any laws.

Please note during busy periods for example Black Friday or promotional periods, there may be delays and delivery may be up to ten working days.

Returns

Skinergy Cosmetics are compliant with all relevant consumer laws and regulations. Under the Consumer Information, Cancellation and Other Rights Regulations 2013, you as a consumer have a "cooling-off" period of two weeks within which you can decide to cancel the contract with us.

Under 13 (2) of the regulation, that right to cancel does not apply to where the products purchased were either used or unsealed after delivery.

To exercise the right of cancellation you must notify us in writing and returning the unsealed products to us. Any goods sent back to us without prior company approval will not be refunded, replaced or repaired.

Please note that the cost of returning these goods is at your expense and furthermore that you as a consumer, are liable for any diminished value resulting from the handling of the goods beyond what is normally necessary.

In returning the products to us, we recommend the use of Tracked reputable postage service for the safe return of the products and further that you ensure they are properly and securely packaged and labelled with our full address.

No right of cancellation, refund or return exists under the consumer regulation (2013) once you have unsealed or indeed used your product unless the product is defective, and you are returning it for this specific reason.

If it is the case that you believe that the product purchased is defective, or not of merchantable quality you have rights under the relevant Sales of Goods Acts and Defective Products Act. In certain circumstances, you may be entitled to a refund, replacement or repair and/or compensation, where goods are faulty or not as described. If you believe any of these to be the case, please email, telephone or write to us within 14 days.

We are fully compliant with EU Regulation (524/2013 – The Online Dispute Resolution) and are committed to providing our customers with a simple, efficient and low-cost way of resolving domestic and cross-border disputes, which may arise from sales.

If you are not able to resolve any customer service issue you may have with a product you have purchased via our website or by telephone, you may wish to consider an alternative dispute resolution. User Generated Content, Affiliate & Creator Licence

By participating in the Skinergy Cosmetics Affiliate Programme, TikTok Shop Affiliate Programme, gifting campaigns, ambassador programme, creator collaborations, or by creating, posting, submitting, uploading or publishing any content relating to Skinergy Cosmetics products (including but not limited to user-generated content (UGC), TikTok Shop content, affiliate content, organic social media content, reviews, testimonials, photographs, videos, reels, stories, livestreams and other promotional material) that:

• tags @skinergycosmetics or @skinergycosmetics_;
• uses #skinergycosmetics or any other Skinergy Cosmetics branded hashtag;
• is submitted directly to Skinergy Cosmetics; or
• is created in connection with any Skinergy Cosmetics campaign, collaboration, gifted product or commercial relationship,

(collectively, the "Content"),

you grant Skinergy Cosmetics a worldwide, perpetual, irrevocable (subject only to applicable law), royalty-free, fully paid-up, transferable, sublicensable and non-exclusive licence to use, reproduce, copy, store, modify, adapt, edit, crop, translate, reformat, publish, distribute, publicly display, publicly perform, communicate to the public, create derivative works from, and otherwise exploit the Content, in whole or in part, in any media or format now known or developed in the future.

This licence expressly includes, without limitation, the right to use the Content for advertising, marketing and promotional purposes across any platform or channel, including but not limited to TikTok, TikTok Shop, Instagram, Facebook, Pinterest, YouTube, Snapchat, LinkedIn, X (formerly Twitter), Google, paid social advertising, Spark Ads, Meta Ads, display advertising, email marketing, SMS marketing, websites, landing pages, ecommerce platforms, printed materials, retail displays, packaging, catalogues, public relations, television, digital media and all other forms of current or future marketing communications, without further notice, approval or compensation unless otherwise agreed in writing by Skinergy Cosmetics.

Skinergy Cosmetics may edit, crop, resize, enhance, retouch, caption, subtitle, dub, overlay graphics, combine with other content, or otherwise modify the Content at its sole discretion, provided such modifications do not materially misrepresent the original context of the Content.

You represent and warrant that:

• you are the sole owner of the Content or otherwise possess all rights, licences, consents and permissions necessary to grant the rights set out in these Terms;
• the Content does not infringe any copyright, trademark, privacy, publicity, intellectual property or other rights of any third party;
• all persons appearing in the Content have provided all necessary permissions for their image, likeness and voice to be used by Skinergy Cosmetics in accordance with these Terms, and where any identifiable person is under 18 years of age, you have obtained the express consent of their parent or legal guardian;
• the Content is truthful, authentic and complies with all applicable laws, advertising regulations and the policies of the platform on which it is published.

To the fullest extent permitted by law, you irrevocably waive (or procure the waiver of) all moral rights and any equivalent rights in the Content and agree not to assert such rights against Skinergy Cosmetics or its affiliates, successors, licensees or authorised partners.

Unless Skinergy Cosmetics has expressly agreed otherwise in writing before the Content is created or published, no royalties, licence fees, usage fees or other compensation shall be payable for Skinergy Cosmetics' use of the Content under these Terms.

Your obligations

You agree that:

• Any information provided by you will be true, accurate, current and complete in all respects.
• You are the authorised holder of any credit or debit card you may use on the website and there are sufficient funds in your account to cover payments for the product(s) ordered.
• You agree not to impersonate any other person or entity or to use a false name, or a name that you are not authorised to use.
• You are eighteen years old or older. If you are under eighteen you may only use the website with the agreement of, and under the supervision of a parent or guardian. If you do not qualify, please do not use this website.
• You will not do any of the following without obtaining prior written permission from us:
• Redistribute or modify any of the content from our website.
• Remove any copyright or trademark notices from any copies of the content.
• Create a database in electronic or structured manual form, by systematically downloading and storing all or any of the content of our website.
• This agreement constitutes the entire agreement between you and Skinergy Cosmetics, with respect to the use of the website. These provisions (terms, conditions, disclaimers and exclusions) shall be construed in accordance with Irish law.
